Terms of Service
These terms (“Terms”) govern your access to and use of the Grit mobile application and related services (the “Service”), operated by Kyle Leung (“Grit”, “we”, “us”). By using the Service you agree to these Terms.
Eligibility
You must be at least 16 years old to use the Service. By using Grit you represent that you meet this requirement and that you are physically cleared to exercise. Consult a qualified medical professional before starting any training program.
Not medical advice
Grit provides general fitness programming and coaching content. It is not medical advice, diagnosis, or treatment. This remains true when you connect Apple Health: health metrics shown in the app, and coaching adjustments informed by them, are for training-personalisation purposes only and are not a medical assessment. Do not disregard professional medical advice or delay seeking it because of anything in the Service. If you experience pain or injury, stop and consult a healthcare provider.
Your account
- You are responsible for the activity on your account and for keeping your sign-in method (Apple ID or Google account) secure.
- Do not share your account with others.
- Notify us immediately if you suspect unauthorised access.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the Service, except to the limited extent applicable law prohibits that restriction.
- Probe, scan, or test the vulnerability of the Service without prior written permission.
- Use the Service to transmit unlawful, harmful, or infringing content.
- Interfere with the integrity or performance of the Service or the data it holds.
Content you provide
You retain ownership of training data, profile information, and health data you provide or connect. You grant us a limited, non-exclusive licence to store, process, and display that data for the purpose of operating the Service, including generating your training program and coaching recommendations. How health data is handled is described in the Privacy Policy.
Our content
Grit’s code, design, logos, and written content are the property of Kyle Leung or licensed to us. You may not copy or redistribute them without permission.
Third-party services
The Service relies on third parties including Apple (Sign in with Apple, Apple Health, App Store in-app purchase), Google (Sign in with Google, Google Play billing), Supabase, RevenueCat (subscription management), and AI providers such as Anthropic (via the Zenmux gateway). Their terms apply to their portions of the Service. See the Privacy Policy for details.
Subscriptions and payment
Grit offers an optional paid subscription, Grit Pro, with a monthly and an annual plan. Some features remain available without a subscription; the app shows what each plan includes before you buy.
- Where you pay. On iPhone you subscribe through Apple’s App Store in-app purchase; on Android, through Google Play. We never receive your card or bank details.
- Price. The price, in your local currency, and the billing period are shown on the purchase screen before you confirm.
- Charge and automatic renewal. Payment is charged to your App Store or Google Play account when you confirm the purchase. The subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
- Cancelling. You can manage or cancel your subscription at any time in your App Store account settings or in Google Play → Subscriptions. Cancelling stops the next renewal; you keep Grit Pro until the end of the period you have paid for. Deleting the app or your Grit account does not cancel a store subscription — cancel it in the store.
- Refunds. Purchases are processed by Apple or Google, and refund requests are handled by them under their policies, except where applicable law requires otherwise.
- Welcome period. New accounts may receive Grit Pro free for a limited period at sign-up, without any payment details. The app shows how long it lasts. It ends by itself and never turns into a paid subscription; afterwards your account continues without Grit Pro unless you subscribe.
- Free trials and offers. If the App Store or Google Play offers a free trial or an introductory price for a plan, the purchase screen states its length and the price that applies when it ends. Any unused part of a free trial ends when you buy a subscription.
- Price changes. If a subscription price changes, Apple or Google notify you before it applies, and where their rules require it you must agree to the new price before you are charged it.
On iPhone, purchases are also subject to Apple’s Licensed Application End User License Agreement.
Termination
You may stop using the Service at any time by deleting your account from the Profile screen or contacting us. We may suspend or terminate your access if you violate these Terms, abuse the Service, or if we are required to do so by law.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific training goals.
Limitation of liability
To the maximum extent permitted by law, Grit’s total liability arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data.
Indemnification
You agree to indemnify and hold Grit harmless from claims, damages, and expenses arising out of your use of the Service in violation of these Terms or of any law.
Governing law
These Terms are governed by the laws of Hong Kong, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in Hong Kong, unless a different forum is required by your local law.
Changes
We may update these Terms from time to time. Material changes will be announced in the app. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
